Mabrey Bank Bill Pay Terms and Conditions
These terms and conditions constitute the agreement ("Agreement") between you and Mabrey Bank ("Service Provider") with respect to the provision of Online Bill Payment Services (the "Service") to you. Your use of the Service constitutes your agreement to be bound by the terms of this Agreement and that your contract is with the Service Provider, who is responsible to you for the provision of the Service. In this Agreement the words "you" and "your" mean each person whom signed the application; the terms "us" and "we" means the Service Provider.
Bill Payment Service
By providing the Service Provider with the names and account information of those persons or entities to whom you wish to direct payment, you authorize the Service Provider to follow the payment instructions that it receives from you through the bill payment program. When the Service Provider receives a payment instruction, you authorize the Service Provider to charge your transaction account on the selected Process Date and remit funds to the designated payee on your behalf.
In the following instructions, the Process Date is defined as the day you request the Service Provider to process the payment. On that date, the funds will be withdrawn from your account.
A Business Day is defined as Monday through Friday up to 2:00 p.m. (Central Time) excluding weekends and holidays.
If you select a Process Date that is a Saturday or a Sunday, the payment will be processed on the next Business Day. If the selected Process Date is a holiday, the payment will be processed on the next Business Day.
Payments are processed each day at 2:00 p.m. Central Time. Any payments entered up to that time will be processed the same day. Any payment issued via check will be printed and mailed the same day. Electronic payments will be sent for processing the same day.
When setting up a payment to be received by the Payee, you should confirm that the "Estimated Arrival Date" is the date you want the Payee to receive the funds, not the "Processing date". The risk of incurring and the responsibility for paying any and all late charges or penalties shall be borne by you.
Note: The Service may not be used to pay taxes or court-directed payments.
The Service Provider will use its best efforts to make all your payments properly. If we do not complete a payment on time or in the correct amount according to the Agreement, we will be liable for your losses and damages. However, there are some exceptions to this liability. For instance, we will not be liable in the following circumstances:
1. If through no fault of ours, you do not have enough funds in your account to make the transfer, or the transfer would exceed the credit limit on any overdraft line associated with the account;
2. The equipment or software used by the Service Provider to provide the Service was not working properly and you knew or were advised by the Service Provider about the malfunction before you executed the transaction;
3. You have not provided the Service Provider with the correct names or account information for those persons or entities to whom you wish to direct payment;
4. Circumstances beyond our control (such as, but not limited to fire, flood, or interference from an outside force) prevent the proper execution of the transaction despite the reasonable precautions we have taken;
5. You have reported your PIN as lost or stolen;
6. Your Service has been cancelled;
7. If the funds in your account are unavailable because of garnishment, levy, or other hold requirements imposed upon us by law or by a government agency or court orders. Also, any holds placed by Mabrey Bank for uncollected funds.
How to set up payees/payments
If you want to add a new "PAYEE", select the "Payee" tab located in the service or speak to a service representative.
You may add a new fixed payment to a "Payee" by accessing the service and entering the appropriate information. Most other additions, deletions, or changes can be made in writing or by using the service.
The Financial Institution reserves the right to refuse the designation of a "Payee" for any reason.
You may pay any "Payee" with-in the United States (including U.S. territories and APO's / AEO's).
The Financial Institution is not responsible for payments that cannot be made due to incomplete, incorrect, or outdated information.
The bill paying process
Single Payments - a single payment will be processed on the business day (generally Monday through Friday, except certain holidays) that you designate as the payment's processing date, provided the payment is submitted prior to the daily cut-off time on that date. The daily cut-off time, which is controlled by the Financial Institution, is currently 2:00 p.m. Central Time.
A single payment submitted after the cut-off time on the designated process date will be processed on the next business day. If you designate a non-business date (generally weekends and certain holidays) as the payment's processing date, the payment will be processed on the first business day following the designated processing date.
Person to Person (P2P) payments are single payments designed to pay individuals. When a Person to Person payment is made, an email is sent to the recipient to verify a keyword that you have established. Be sure to make payee aware of the keyword. By using the keyword, no account information is shared between you and the payee. The recipient verifies the account and enters account information.
When a recurring payment is processed, it is automatically rescheduled by the system. Based upon your selected frequency settings for the payment, a processing date is calculated for the next occurrence of the payment. If the calculated processing date is a non-business date (generally weekends and certain holidays), it is adjusted based upon the following rules:
• If the recurring payment's "Pay Before" option is selected, the processing date for the new occurrence of the payment is adjusted to the first business date prior to the calculated processing date.
• If the recurring payment's "Pay After" option is selected, the processing date for the new occurrence of the payment is adjusted to the first business date after the calculated processing date.
If your frequency settings for the recurring payment specify the 29th, 30th, or 31st as a particular day of the month for processing and that day does not exist in the month of the calculated processing date, then the last calendar day of that month is used as the calculated processing date.
Limits on Transactions
A limit for bill payments sent as electronic (ACH) items is $20,000.00 per item for consumer Bill Pay Plus. A limit for bill payments sent as electronic (ACH) items is $20,000.00 per item for business Bill Pay. A daily electronic (ACH) limit for business payments is $100,000.00. E-mail Payments (Person to Person) and Transfers through consumer and business Bill Pay have an item and daily limit of $2,000.00.
Single and Recurring Payments
The system will calculate the Estimated Arrival Date of your payment. This is only an estimate, so please allow ample time for your payments to reach your "Payees".
Cancelling a Payment
A bill payment can be changed or cancelled any time prior to the cutoff time on the scheduled processing date.
Electronic payments will verify funds prior to processing. If funds verification fails due to Non-Sufficient Funds (NSF) we will attempt to verify funds for 3 business days. The payment will be cancelled if funds are not available after 3 business days of attempting to verify funds.
Password and Security
You agree not to give or make available your Online Personal Identification Number "PIN" to any unauthorized individuals. If you believe that your PIN has been lost, stolen or that someone may attempt to use the Service without your consent or has transferred money without your permission, you must notify the Service Provider at once by calling Mabrey Bank at 1-888-272-8866 or 918-366-4000.

If we decide to do this, we will credit your account within 20 business days for the amount you think is in error so that you will have the use of the money while we complete our investigation.
We will tell you the results within three business days after completing our investigation. If we decide that there was no error we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.
Disclosure of account information to third parties
Please refer to your account disclosures and product brochure for applicable charges.
In the event of insufficient funds
Check Payments: Checks will be handled in the same manner as a check that is written from your checkbook against an insufficient balance.
Electronic Payments: During daily processing, the electronic payment files are verified for funds availability. If the funds are available, your account will be charged for the payment, and the payment will be processed. If funds verification fails due to Non-Sufficient Funds (NSF) we will attempt to verify funds for 3 days. The payment will be cancelled if funds are not available after 3 business days of attempting to verify funds.
If you have authorized the bank to utilize Bounce Protection in the payment of check, ACH, ATM or POS transaction, you may incur a fee for insufficient funds when using this service. Please refer to your account disclosures for applicable charges.
Check Payments may be stopped after the check is printed and mailed. You will need to view the payment history to obtain the check number, and then contact Mabrey Bank. If you call, we will require you to put your request in writing and get it to us within 14 days after you call. Refer to Errors and Questions Section for the telephone number and address.

The Service Provider is obligated to notify you promptly if it decides to refuse to pay a person or entity designated by you. This notification is not required if you attempt to pay tax or court-related payments, which are prohibited under this Agreement.
You agree that the Service Provider reserves the right to obtain financial information regarding your account from a merchant, another payee or financial institution to resolve payment-posting problems.
In the event of a dispute regarding the Service, you and the Service Provider agree to resolve the dispute by looking to this Agreement. You agree that this Agreement is the complete and exclusive statement of the agreement between you and the Service Provider which supersedes any prior agreement, oral or written, and any other communications between you and the Service Provider relating to the subject matter of this Agreement except to the extent that this Agreement may be subsequently modified by the Service Provider posting additional terms or modifications to the Web Site as described under the Alterations and Amendments section of this Agreement above. Safety precautions to use regarding your internet banking accounts
1. Never share your online banking user name and password. Any individual who has your user name and password can successfully masquerade as you online and can access your accounts;
2. Choose your password wisely. (Do not use information that could be easily guessed, such as you date of birth or social security number).
3. If you find it necessary to write down your user name and password, keep the information in a safe place, away from prying eyes. Do not leave it in an unsecured spot where another person may view it.
4. If you suspect that your user name and/or password may have been compromised, report it to the bank immediately.
5. Change your password periodically. A password is like a piece of chewing gum. It should not be shared and it's best when fresh.
6. Avoid accessing online banking through a public computer, such as one at a library or a cyber café where a malicious user may have installed a keystroke logging program or a password sniffer. It is virtually impossible to guarantee your transmission will be secure on such a machine.
7. If you are going to access your online account on a machine that is accessible to other users, such as a roommate, coworker, or family member, take precautions:
8. If using Internet Explorer, before you access the bank's web site, go first to the menu bar at the top of the browser. Choose Tools/Internet Options. In the dialog box that appears, click on the Content tab. Then click on the "Auto Complete" button. Uncheck all auto complete buttons.
At the end of your session, click on Tools/Internet Options, and click on the button to "Delete Temporary Files". Then click OK.
Close the browser.
9. Monitor your account frequently for any unauthorized transactions and report them to the bank immediately.
Mabrey Bank endeavors to provide you with the highest quality Mobile online banking available. This Agreement states our obligations with respect to our Mobile Online Banking service (the "Service').
We will use reasonable efforts to make the Service available for your use on a continuous basis. The Service may be unavailable for short periods of time for regular or emergency system maintenance. We will endeavor to have our scheduled maintenance occur during non-peak hours. In addition, accessibility to the Service may be interrupted because of conditions beyond our control, including outages in internet availability. We will use diligent efforts to re-establish the Services as promptly as possible. We do not promise the Service will always be available for your use. Mabrey Bank may terminate use of the Service at any time. Neither termination nor discontinuation shall affect your liability or obligation under this Agreement.
You are responsible for providing your own hardware and software to access the Service. The hardware and software that you use may be subject to unauthorized tracking or other manipulation by "spyware" or other malicious code. We are not responsible for advising you of the existence or potential effect of such malicious code, and your use of your hardware and software is at your own risk. We do not guarantee functionality of the Service on all wireless devices. You are responsible for the charges of any wireless service provider while using the Service.
We reserve the right at all times to take actions to protect our systems and information, including denial of access to users of the Service.
We will use commercially reasonable efforts to secure the Service to prevent access by unauthorized persons and to prevent the introduction of any malicious code, such as a computer virus. However, no security system is failsafe, and despite our efforts the security of the Service could be compromised or malicious code could be introduced by third parties. We will provide you with notice if your information is the subject of a security breach as required by applicable law.
The accounts that you access using the Service are subject to the Online Banking Terms and Conditions.

We proudly support all efforts to protect and maintain the Security of our customers and our country.
